Bonus And Commission

Bonus And Commission Claims

For many high flyers the most important aspect of their remuneration will be the bonus or commission payment.  A claim relating to a bonus or payment of commission is most likely to be a contractual claim rather than an employment law claim in the Tribunal.  The exception is where discrimination has led to a bonus or commission employment law claim.

We often get enquiries on these issues - bonus schemes can include share options or carry provisions, commission or bonuses may have been paid in the form of a forgivable loan or there may be a profit share or partnership element.  We have already had a number of cases on claw back provisions and reviewed them in employment contracts and we expect, given the current furore, to see more on these issues.

If you are concerned about your bonus or commission the easiest solution is to call us and explain all of the circumstances.  We can give you fast cost effective advice as to whether you have a claim and a strategy to negotiate a settlement with your employer.

If you are about to take a new job, then remember that preventative medicine works best.  Consult your headhunter and consider taking specialized employment law advice, as we will apply our expertise to protect your best interests when we review your contract.

There are a number of employment law issues in this area, including oral contracts, open or guaranteed schemes and discretionary bonuses.
