Can I Buy A Compromise Agreement On The Internet?

Compromise Agreements

The short answer is yes, plenty of sites will sell you a standard form compromise agreement.  However, you still need both to have correctly identified the risk of the employee bringing an employment law claim and to have assessed your potential liability in order to calculate the compensation that you should offer in the compromise agreement and to determine exactly what terms are necessary in the compromise agreement.  For example, the real risk for your business may be in offering an ex-gratia payment to the employee only to discover that the day he or she leaves they go to work directly for a competitor.

Even where the scenario seems simple, such as a redundancy or mutually agreed exit, there are always traps for the unwary, not only in the procedure used or the terms of the agreement but also in the timing of offering a compromise agreement.

You could also look to save costs by using employment consultants or other telephone help lines.  Recent case law has shown that advice received in this way is not subject to legal privilege - which means you would have to show it to the employee in any tribunal or court proceedings.  This could be disastrous for you if the advice you are given is that you have not got a fantastic defence.

The advantage of using experienced employment solicitors is that you do not need to worry about this - the advice we give to you can never be seen by your employee.  We can ensure the compromise agreement reflects the true circumstances as well as meeting the goals of your business in order to achieve a fast and cost effective solution for you and the employee.
