To bring a claim for unfair dismissal the employee must show that the employer has not dismissed them for one of the five permitted (‘fair') reasons.  In general, an employee will give a reason for the dismissal and it is for the employee to show that the reason did not apply or that the reason given was not one of the five permitted reasons.  If they can do so then the employee will have a good substantive claim for unfair dismissal.  However, it may also be possible the employee can show that the employer acted incorrectly on procedure.  There are also certain circumstances where your dismissal is an automatic unfair dismissal.  In some cases of automatic unfair dismissal it does not matter how long you have worked for you employer.  If you are unsure about whether you have a claim for unfair dismissal then call Andrej or Ruth to discuss your case in confidence and free of charge.  We can quickly ascertain if you have an employment law claim
