Unfair Dismissal

An employee can be dismissed for misconduct although such a dismissal can be unfair dismissal depending on the circumstances of the case.  This can be any misconduct, including, amongst others, disobeying a direct order, making disparaging remarks to customers, absence without leave, drunkenness at work and lateness.  It is possible for it to cover conduct outside work, for example where an employee commits a criminal offence.  It is also possible to summarily dismiss for gross misconduct, which means an employee can be dismissed without notice.
